Michael Gvozdenovic

Michael is an experienced litigator who advises clients on strategic contentious matters and helps clients to navigate and resolve significant disputes. He focuses on regulatory disputes, investigations, and inquiries, with particular expertise in competition and consumer law matters. This includes complex market leading contested merger proceedings, cartel investigations and immunity applications, other Part IV competition advice and high-profile class action cases. He has experience in the technology & telecommunications, energy and resources, financial services and infrastructure sectors.

Michael’s experience includes advising:

• a major digital platform alleging misuse of market power contraventions against Apple and Google
• a major mining company in Part IIIA proceedings against the Port of Newcastle
• a major mining association in the Australian Competition Tribunal 
• the contested merger between Pacific National and Aurizon in the Federal Court and High Court of Australia
• the Federal Court proceedings concerning the merger between VHA and TPG as against the ACCC
• a major automobile company in a high profile class action against the ACCC and consumers
• a market leading technology company in misleading and deceptive conduct proceedings brought by the ACCC
• a major financial institution in the Royal Commission into Misconduct in the Banking, Superannuation and Financial Services Industry, including a secondment to the Regulatory Legal team
• various sectors involved in ACCC investigations, including responding to compulsory notices to produce information and documents

Background

Michael holds a Master of Laws (LLM) from Columbia Law School (graduating as a James Kent Scholar and studying on a Fulbright scholarship) and a combined Bachelor of Laws (Honours) and Economics from the University of Sydney.

Michael is a co-editor of a leading two-volume Australian competition law text, Current Issues in Competition Law. He is also a Sessional Academic at Sydney Law School.

Michael is admitted to practise as a solicitor of the Supreme Court of NSW and the High Court of Australia. Prior to joining Herbert Smith Freehills, Michael was Associate to the Honourable Justice Wigney of the Federal Court of Australia, and practised competition law at Clifford Chance and Clayton Utz.
