Tse Wei is an international arbitration lawyer specialising in construction and engineering disputes.

Tse Wei represents and advises multinational clients in complex cross-border commercial and investment disputes across a range of sectors, including engineering, construction, telecommunications, mergers and acquisitions, cryptocurrency and shareholder disputes.

He has advised and acted in arbitrations under various institutional rules (including ICSID, ICC, AIAC, UNCITRAL, and SIAC) seated in Europe, the Middle East, North Africa, and Asia. He possesses working experience with public international law and international commercial disputes under civil and common law systems. His experience also includes managing and coordinating proceedings in multiple jurisdictions.

Tse Wei also has experience with litigation before Malaysian courts on disputes across a broad range of industries, including complex contractual and shareholder disputes, and has acted as sole counsel in arbitration-related applications and contentious insolvency proceedings.

Tse Wei's experience includes advising:

  • a multinational telecommunications conglomerate in relation to ICSID investment treaty claims and concurrent claims under the World Trade Organisation dispute resolution regime against an Asian State.
  • a project company on issues arising out of the engineering, construction, and operation of a refinery and petrochemical complex, including a Singapore-seated SIAC arbitration, involving claims under and in relation to the EPC Contract.
  • an English purchaser on claims and shareholder rights management strategies in relation to the acquisition of an Asia-wide legacy insurance portfolio.
  • a Chinese main contractor on potential disputes concerning the reconstruction of a major national highway in Kazakhstan under a Kazakh law-governed FIDIC Pink-based agreement.
  • a Malaysian contractor in an ICC arbitration under UAE law arising from a FIDIC-based agreement for a landmark mixed-use development project.
  • a Malaysian purchaser in an SIAC arbitration in relation to the management of shareholder rights under Indonesian law.

 

 

Background

Tse Wei was called to the Malaysian and English Bars.  He holds a Bachelors and Masters of Law from the London School of Economics, and is a Fellow of the Chartered Institute of Arbitrators. 

Tse Wei also sits on the AIAC Standard Form Building Contracts Expert Advisory Committee. He is fluent in English and Malay.
