There are so many ESG-related publications and developments that it is hard to keep abreast of them all. For this reason, every two weeks, our firm has been publishing a tracker of ESG-related publications and developments, with a primary focus on developments that may be of most interest to or impact our clients, be they corporates, asset managers or asset owners.

Key updates covered in this edition include:

  • the draft report on a preliminary set of recommendations for the EU Taxonomy’s technical screening criteria published by the Platform on Sustainable Finance subgroup which focuses on presenting a first set of ‘priority’ economic activities and draft recommendations for “substantial contribution” and “do no significant harm” technical screening criteria, as well as our legal briefing on the draft report;
  • the joint publication of a best practice guide to sustainability linked leveraged loans by the Loan Market Association and the European Leveraged Finance Association, which provides practical guidance as to the application of the Sustainability Linked Loan Principles to “ordinary” leveraged loans which seek to incorporate any kind of ESG factor or metric; and
  • our recent article, “Integrating Circular Policies Closing the Loop”, on key legal considerations for private-sector businesses engaged in the journey towards circularity.
