Adil Kourtih is an associate in the Energy and Infrastructure team in the Paris office.

Adil specialises in the development, construction and acquisition of projects in the energy and infrastructure sectors.

Adil supports the firm's clients on transactional matters (analysis and drafting of concession agreements, EPC, O&M, PPAs, etc) and public law/regulatory issues. He also advises clients on their litigation and pre-litigation strategies in France, Francophone Africa and the European Union.

He has extensive experience of advising on complex projects and corporate PPAs, including notably the structuring / bankability analysis of project agreements and regulatory aspects.

Adil's experience includes advising; 

  • Lenders on the financing of the expansion project of the International Airport of Sihanoukville in Cambodia (deal value: USD 270 million)
  • Renault Group on the structuring, negotiation and signing (with Voltalia) of the largest corporate PPA ever signed in France (350 MWp)
  • OneWeb, in relation to its combination with Eutelsat Communications, a listed French satellite and telecommunications company (deal value: USD 3.4 billion)
  • Dombasle Energie on a greenfield heat (181 MW) and electricity (17,5 MW) facility project on one of Solvay’s industrial site in France, including the review and negotiation of the project documents (offtake, EPC, O&M, Fuel supply and ancillary agreements) as well as regulatory aspects including green energy certificates (deal value: EUR 225 million)
  • a major oil & gas company regarding the assistance in pre-litigation and litigation actions before the French Conseil d’Etat and the European Court of Justice regarding the French biofuels legal framework
  • West African Power Pool on the development of a tender documentation including a long form PPA for the development of 150MW hybrid solar power plant with storage both in Mali, Burkina Faso and Niger
  • Lenders on the financing of the development, construction and operating costs of a 446 megawatt combined cycle gas power plant (Landivisiau power plant)
  • Genmin on the structuring, negotiation and signing of a long-term power purchase agreement (with Société de Patrimoine du Service Public de l'Eau Potable, de l'Energie Électrique et de l'Assainissement) for the supply of renewable hydroelectricity to its wholly owned Baniaka iron ore project
  • Aquind Limited on the development of the 2000MW UK - France Interconnector, including French public law issues, review and analysis of the agreements for seabed occupancy and project documentation
  • Construcciones y Auxiliar de Ferrocarriles S.A on its acquisition of Alstom's subsidiary (Alstom Percy) including due diligence of all the Alstom Percy's assets

 

Background

Adil graduated from SciencesPo Paris with a Master in Public Affairs (first rank in the competitive entrance exam) and studied at the Law School and Faculty of Business and Economics of the University of Melbourne (first class honours). He also holds a Master in Economic Public Law (valedictorian) from the University of Paris II Panthéon-Assas and a law degree from the University of Paris I-Panthéon Assas (first class honours).

Adil is a Lecturer in public law at the University of Paris II Panthéon-Assas. He is also a Teacher/Examiner in Law at the Ecole Normale Supérieure preparatory class of Lycée Turgot.
